Captain's Rewards Rules

Important

The following provisions form the basis of The Moorings Captain's Rewards Program. These provisions will govern your participation in the Program, and it is your responsibility to read and understand all of them. For updates to the program, contact The Moorings or visit the Captain's Rewards webpage at moorings.com. These Program Rules cannot be superseded or changed, except in writing by The Moorings.

Eligibility

Effective February 15, 2003 upon successful completion of one Moorings bareboat charter directly booked with The Moorings, the head charterer will receive a Moorings Captain card and become eligible for participation in and benefits of Moorings Captain's Rewards Program. Only the head charterer will receive credit towards the Program. Moorings Captains holding cards issued prior to February 15, 2003 are also eligible for the Program.

The Captain's Rewards Program is maintained for the benefit and participation of individual members only. Only individuals are eligible for Program membership, and each member may maintain only one account. Duplicate accounts will be subject to cancellation. Only the member named on the account will be entitled access to personal account information.


General Conditions
Participation in The Moorings Captain's Rewards Program (the "Program") is subject to any terms and conditions, rules, regulations, policies, and procedures ("Program Rules") that The Moorings may, at its discretion, adopt from time to time.

The Moorings has the sole right to interpret and apply the Program Rules. Any failure to follow Program Rules, any abuse of Program privileges, any conduct detrimental to the interests of The Moorings, or any misrepresentation of any information furnished to The Moorings or its affiliates by any member, or anyone else acting on the member's behalf, may result in the termination of his or her membership, the cancellation of accrued certificates, awards or benefits.

Captain's Rewards Program membership and its benefits are offered at the discretion of The Moorings. The Moorings has the right to terminate the Program or to change the Program Rules, regulations, benefits, conditions of participation or levels, partner benefits, in whole or in part, at any time, with or without notice, even though changes may affect the value of the credits or certificates already accumulated.


The Moorings may, among other things, withdraw, limit, modify or cancel any award or partner benefit; increase the charters or number of certificates required for any award; modify or regulate the transferability of awards or benefits; add an unlimited number of blackout dates; limit awards on certain yacht types; or limit the number of award inventory available to any or all destinations.

Any discounts available, as part of this program may not be combinable with all discounts or special promotions. Combinability is at the sole discretion of The Moorings. Members, in accumulating charters or certificates, may not rely upon the continued availability of an award or award level, and members may not be able to obtain all offered awards or use awards to all destinations or on all yachts.

Program awards, accrued credits and special offers are subject to government regulations. The Moorings is not responsible for products and services offered by other participating companies. Any departure fee, immigration fee, security fee, tax liability surcharge or any other fee or surcharge (whether enacted by a governmental authority or otherwise) is the responsibility of the passenger and/or the Program member.


Each member shall be responsible for remaining knowledgeable as to the Program Rules. The Moorings shall attempt to advise active members of various matters of interest through such means as may be appropriate, such as account summaries, emails, newsletters and its Web site, but The Moorings shall have no liability for any failure to do so.

The Moorings will not be responsible for correspondence lost or delayed in the mail. Each member shall be responsible for advising The Moorings of any change of address, and The Moorings shall have no liability for misdirected mail or any consequences thereof.

The accumulation of charters or certificates and the redemption of awards are subject to specific Program Rules enacted by The Moorings. Each member is responsible for reading those materials in order to understand his or her rights and responsibilities under the Program. No charters, benefits, certificates or awards earned or granted under the Program may be transferred or assigned except as expressly permitted by The Moorings in writing.


Accrued charters and certificates do not constitute property of the member. Neither accrued charters nor certificates are transferable (i) upon death, (ii) as part of a domestic relations matter, or (iii) otherwise by operation of law.

At no time may Moorings program benefits or awards be purchased, sold or bartered. Any such benefits are void if transferred for cash or other consideration. Violators (including any passenger who uses a purchased or bartered award) may be liable for damages and litigation costs, including Moorings attorney's fees incurred in enforcing this rule.
